Apex Snow Removal Ltd. (Apex Snow Removal)

1. Introduction

These Terms and Conditions (“Terms”) govern the use of services provided by Apex Snow Removal Ltd. (“Company”, “we”, “us”, or “our”).

By engaging our services or using our website, you agree to be bound by these Terms.

2. Services Provided

Apex Snow Removal provides winter maintenance services including, but not limited to:

  • Snow removal
  • Ice prevention (salting/de-icing)
  • Sidewalk and walkway clearing
  • Property safety monitoring during winter conditions

Services are provided for residential, commercial, and multi-family (strata) properties.

3. Service Triggers & Dispatch

Services are performed based on weather conditions and risk assessment.

  • Ice Prevention (Salting):
    Applied when temperatures are forecasted to be at or below 0°C, based on data from AccuWeather.
  • Snow Removal:
    Performed when a visible accumulation of snow is present on-site.
  • Dispatch decisions are based on:
    • Forecasted temperatures
    • Risk of freezing or refreezing
    • Surface conditions
    • Time of day (overnight service window)

Important:
Services may be performed proactively before hazardous conditions occur, even if precipitation is not present at the time.

4. Automated Service Operations

Apex Snow Removal uses an automated dispatch system.

  • Services are triggered without prior approval for each visit
  • Notifications and service reports are generated automatically
  • Clients are responsible for understanding the service triggers outlined in their agreement

5. Service Reports & Documentation

After each service, reports may include:

  • Time-stamped records
  • Before and after photos
  • Weather conditions at time of service

Reports are available upon request or provided through automated systems.

6. Client Responsibilities

Clients agree to:

  • Ensure access to service areas (no blocked driveways, vehicles, etc.)
  • Notify us of any hazards or special site conditions
  • Maintain clear communication for billing and contact information

Failure to provide access may result in incomplete service without liability to the Company.

7. Limitation of Liability

Apex Snow Removal takes all reasonable precautions to reduce risk; however:

  • We do not guarantee completely ice-free or snow-free surfaces at all times
  • Weather conditions can change rapidly and unpredictably

The Company shall not be held liable for:

  • Slip and fall incidents where reasonable service was provided
  • Damages caused by hidden obstacles (e.g., curbs, unmarked objects)
  • Delays due to extreme weather, traffic, or unforeseen conditions

8. Property Damage

While care is taken during service:

  • The Company is not responsible for damage to:
    • Unmarked curbs or edges
    • Loose landscaping materials
    • Items buried under snow

Clients are responsible for clearly marking hazards prior to the season.

9. Billing & Payment Terms

  • Invoices are issued based on services performed
  • Standard terms: Net 30 days
  • Overdue balances may be subject to interest charges

The Company reserves the right to:

  • Suspend services for non-payment
  • Pursue collection on outstanding balances

10. Contractual Priority

Where a signed service agreement exists:

  • The Service Agreement overrides these Terms
  • These Terms apply primarily to website users and general inquiries

11. Service Modifications & Termination

The Company reserves the right to:

  • Modify service schedules due to weather or operational needs
  • Terminate services for:
    • Non-payment
    • Safety concerns
    • Breach of agreement

Termination does not waive payment obligations for services already performed.

12. Website Use

By using this website, you agree:

  • Not to misuse or attempt to disrupt the website
  • Not to copy or reproduce content without permission

All website content is the property of Apex Snow Removal.

13. Privacy

Any personal information collected through this website is handled in accordance with our Privacy Policy.

14. Changes to Terms

We reserve the right to update these Terms at any time.
